Frankfurt Regional Court rejects Wirelane application for preliminary injunction against Tesla

The first round of the legal dispute between the charging station start-up and Elon Musk's electric car manufacturer has gone to the US company. Now the Wirelane founder could sue.

The Frankfurt Regional Court rejects Wirelane's application for a temporary injunction against the installation and distribution of Tesla charging stations, reports dpa. This means that the Munich-based start-up must also bear the costs of the proceedings with a value in dispute of 100,000 euros. The court spokeswoman justified the decision, among other things, with the information situation - Wirelane had already known about the uncalibrated Tesla charging stations since mid-2021 due to a press article, so there was no need for an urgent decision.

The decision is not yet legally binding. Wirelane can lodge an appeal with the Frankfurt Higher Regional Court. Owner Constantin Schwaab announced that he would take legal action against Tesla in the event of a defeat. The application related to the so-called Tesla Superchargers, which do not comply with German calibration law. This means that customers do not know how much electricity they have received from a hotel, for example, which often charges a flat rate.

The court's reasoning states that the chargers and not Tesla are responsible for the lack of price information. Schwaab still believes he is in the right and quotes in a Linkedin commentary from the court ruling: "The required retrofitting of the Superchargers and implementation of the conformity assessment procedure has not yet taken place." Schwaab therefore criticizes the court's decision. It clearly states that the Superchargers are being operated illegally, which has been public knowledge since 2021. "How is that possible?" asks the Wirelane owner. He has not yet commented on any further action.
