Frankfurt Regional Court rejects Wirelane's request for preliminary injunction against Tesla

In the legal dispute between the charging column start-up and Elon Musk's e-car maker, the first round goes to the US company. Now the Wirelane founder could sue.

The Frankfurt Regional Court rejects Wirelane's application for an injunction against the installation and transfer of Tesla charging stations, reports dpa. As a result, the Munich-based start-up must also bear the costs of the proceedings, which have a value in dispute of 100,000 euros. The court spokeswoman justifies the decision, among other things, with the information situation - Wirelane already knew about the uncalibrated Tesla charging stations since mid-2021 because of a press article, so there was no need for an urgent decision.

The decision is not yet legally binding. Wirelane can appeal to the Frankfurt Higher Regional Court. Owner Constantin Schwaab announced that he would file a lawsuit against Tesla in the event of defeat. The application related to the so-called Tesla Superchargers, which do not comply with German calibration law. The customer would not know how much electricity he had received from a hotel, for example; hotels often charge a flat rate for this.

The court's reasoning states that the chargers, and not Tesla, are responsible for the lack of price information. Schwaab still considers himself to be in the right, citing in a Linkedin commentary from the court ruling, "The required retrofitting of the Superchargers and implementation of the conformity assessment procedure has not yet taken place." Schwaab therefore criticizes the court's decision. It clearly states that the Superchargers are operated illegally, which has also been publicly known since 2021. "How is that possible?" the Wirelane owner wonders. He has not yet commented on any further action.
